Terms of Service

These Terms of Service ("Terms") govern your purchase and use of the Montori desktop application ("Montori," "the Software") and any related services. By buying or installing Montori, you agree to these Terms. If you don't agree, don't buy or use the Software.

The Software is sold and supported by an independent developer (the "Operator"). Contact: support@montoriapp.com

1. License — what you can do

When you buy Montori, you receive a personal, non-transferable license key that lets you:

Install and use the Software on up to 2 distinct computers that you personally own or control
Use the Software for personal or commercial reselling, bookkeeping, and inventory-tracking purposes
Receive all future v1.x updates of the Software at no additional cost
Email the Operator for support; reasonable response time is ~24 hours for legitimate purchases

This is a license, not a sale of the software itself. The Operator retains all rights to the underlying source code and intellectual property.

2. What you CAN'T do

You may not:

Share your license key with anyone outside your household
Resell, redistribute, or sublicense the Software, in whole or part
Decompile, reverse-engineer, modify, or create derivative works of the Software (except where the law permits, e.g., interoperability)
Remove or alter copyright notices, license-check logic, or attribution in the Software
Use the Software to store, manage, or facilitate the sale of illegal items, stolen goods, counterfeits, or anything prohibited by the platforms you list on (eBay, Facebook Marketplace, Amazon, etc.)
Use the Software's local web server to host content for parties other than yourself

If you violate these terms, the Operator may revoke your license without refund. The Operator reserves the right to revoke any license suspected of being shared, resold, or otherwise misused.

3. Refund policy

30 days, no questions asked.

If Montori isn't right for you, reply to your Gumroad purchase receipt and request a refund. Gumroad processes refunds directly — usually instantly, or within a few business days. After refund, your license key is deactivated and you should uninstall the Software.

Refund requests after 30 days are at the Operator's discretion and not guaranteed.

4. Updates and continued availability

The Operator may release updates, patches, and bug fixes at their discretion. All v1.x updates are included in your purchase.
A major version bump (e.g., v2.0) may be offered as a paid upgrade. You are never obligated to upgrade.
The Operator may discontinue the license server at any time. If the license server is permanently shut down, the Operator will release a final build with the license check disabled so existing buyers can continue using the Software locally. Your data on your PC stays accessible regardless.

5. Account / activation

Your license allows activation on up to 2 distinct machines.
If you need to reset activations (new PC, replaced hardware, clean reinstall on the same machine), email the Operator with your license key + purchase email. They'll reset slots for legitimate buyers within ~24 hours.
Excessive or suspicious activation requests (e.g., 10+ machines, key appearing on torrent sites) may result in the license being revoked without refund.

6. Local data — your responsibility

The Software stores all your inventory data, photos, and settings on YOUR computer. The Operator has no copy and cannot recover your data if you lose it.

You are responsible for backing up your data folder (default %APPDATA%\Montori\ and Documents\Montori-Photos\). The Operator strongly recommends regular backups to Google Drive, OneDrive, Dropbox, or a USB drive.

7. No warranty

The Software is provided "AS IS" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, the Operator is NOT liable for:

Lost data, lost profits, lost sales, or business interruption
Tax penalties, missed tax deadlines, or incorrect tax filings (the Software's tax features are estimates; consult a real CPA for actual tax planning)
Bans, suspensions, or other actions taken by eBay, Facebook Marketplace, Amazon, or any third-party platform
Hardware damage, security breaches, or any indirect, incidental, consequential, or punitive damages

In any case, the Operator's total liability to you under these Terms is limited to the amount you paid for the Software.

8. Tax features are not tax advice

Montori includes income-tax estimation, deduction tracking, and similar features as a convenience for your own bookkeeping. These are not tax advice and should not be used as the sole basis for filing your taxes. Consult a licensed CPA for actual tax planning.

9. Third-party services

Montori uses the following third-party services, each governed by their own terms:

Gumroad — payment processor (gumroad.com/terms)
Cloudflare — license server hosting (cloudflare.com/website-terms)
Electron / Chromium — runtime (open source, MIT/BSD licenses)

Montori is not affiliated with eBay, Facebook Marketplace, Meta, Amazon, or any other listing platform.

10. Governing law

These Terms are governed by the laws of the United States and the developer's state of residence, without regard to conflict-of-law principles.

11. Changes to these Terms

The Operator may update these Terms at any time. Material changes will be posted at montoriapp.com/terms and the "Last updated" date will be revised. Continued use of the Software after changes constitutes acceptance.
